Employment
We have a strong employment litigation and counseling practice, which includes:
- Defending against employment actions involving non-compete agreements, anti-discrimination laws, the False Claims Act, the FLSA, tort and contract allegations, defamation, privacy and property issues, whistleblower statutes, and trade secrets.
- Representing schools and administrators in internal faculty tenure denials and dismissals, employee disciplinary and termination proceedings, and related agency and court challenges.
- Defending institutions and individuals in multi-party injunctive, damage, and declaratory actions, as well as on appeal.
- Defending institutions against faculty and staff claims arising from merger, affiliation, or school closure.
- Defending against EEOC action allegation of a “pattern or practice” of race and gender discrimination in corporate hiring, promotion, and pay practices.
Our employment practice is not limited to litigation but also includes significant training, policy-writing, and “real-time” counseling. Our employment counseling practice includes:
- Drafting and revising employee contracts, non-compete agreements, and confidentiality agreements.
- Designing, screening, and implementing reductions-in-force.
- Advising clients about compliance with the FLSA and the anti-discrimination laws, including the FMLA, ADA, and Title VII.
- Conducting prompt and thorough internal investigations and reporting the results to management in a privileged setting.
